WHEREAS through a Resolution of the 72nd General Assembly in Mexico City the Judicial Branch was called upon to resolve in first instance the controversy between five journalists and the Grupo La República group against Empresa Editora El Comercio, there not having been to date a pronouncement regarding this

WHEREAS we reiterate the request by five journalists and the Grupo La República group for the IAPA to pronounce on the delay of the Peruvian Judicial Branch that still there has not been resolved in first instance the call for the request for protection under the law submitted in November 2013 against Empresa Editora El Comercio for the acquisition it had made of shares of Empresa Periodística Nacional (today Prensmart)

WHEREAS the matter in question is the subject of debate within the IAPA and that institution has not taken a position regarding this

WHEREAS according to Peruvian laws this process should have been resolved within a fixed time limit and there have past more than three years since the presentation of the legal action

WHEREAS for the IAPA it is necessary that the Judicial Branch resolve this controversy as justice delayed is not justice

WHEREAS Principle 1 of the Declaration of Chapultepec states "No people or society can be free without freedom of expression and of the press. The exercise of this freedom is not something authorities grant, it is an inalienable right of the people".

THE IAPA MIDYEAR MEETING RESOLVES

to call upon the Judicial Branch to resolve the present controversy as soon as possible.
