WHEREAS the request by five journalists and the Grupo La República group that the IAPA pronounce on the delay by the Peruvian Judicial Branch that has not yet resolved in first instance the request for injunction submitted in 2013 against the Empresa Editora El Comercio publishing company regarding the acquisition of the shares of Empresa Periodística Nacional (today Prensmart)


WHEREAS the issue is a matter of discussion in the IAPA and the institution has not taken a position regarding it


WHEREAS under Peruvian laws this process should have been resolved within a fixed time limit and there have passed more than three years since the filing of the lawsuit


WHEREAS for the IAPA what is necessary is that the Judicial Branch resolve this controversy justice that is delayed is not justice


WHEREAS the Principle 1 of the Declaration of Chapultepec says: No people or society can be free without freedom of expression and of the press. The exercise of this freedom is not something authorities grant, it is an inalienable right of the people".


THE IAPA GENERAL ASSEMBLY RESOLVES


to call upon the Judicial Branch to resolve the present controversy as soon as possible.
