WHEREAS the Supreme Court of Buenos Aires province in September overturned a decision by the Appeals Court to release from prison José Luis Auge, Gustavo González and Horacio Braga and police officers Gregorio Ríos, Sergio Camaretta and Aníbal Luna, all having been found guilty of the murder of news photographer José Luis Cabezas WHEREAS in February 2000 the Dolores Criminal Court had found the accused guilty of the January 25, 1997 murder of Cabezas WHEREAS on November 13, 2003 the Appeals Court upheld all the verdicts but applied the “2x1 Law,” which doubled each year spent in prison awaiting trial – the reason Augue, González and Braga were paroled WHEREAS Principle 4 of the Declaration of Chapultepec states that “Murder, terrorism, kidnapping, intimidation, the unjust imprisonment of journalists, the destruction of facilities, violence of any kind and impunity for perpetrators severely restrict freedom of expression and press freedom. Such acts must be investigated promptly and punished harshly” THE IAPA GENERAL ASSEMBLY RESOLVE to urge the Argentine authorities to ensure compliance with the decision of the Supreme Court of Buenos Aires province, so that those responsible for what is considered the worst crime in the history of the country against a journalist receive due punishment and there remain no sign of impunity in the case.
