WHEREAS the Constitutional Court, in accordance with international standards, on September 4 revoked the ruling against the newspaper La Hora, which granted a protection action in favor of the Executive Office and the National Government, issued in 2012 by a civil judge of Pichincha and ratified by the Pichincha Provincial Court
WHEREAS the Democracy Code, in the process of being amended, goes against freedom of expression of the candidates and citizens in electoral times, as against the commercial rights of the media
WHEREAS both Principle 5 of the Declaration of Principles of the Office of Special Rapporteur for Freedom of Expression of the Inter-American Commission on Human Rights and Principle 5 of the Declaration of Chapultepec establish that "the arbitrary imposition of information and the creation of obstacles to the free flow of information violate the right to freedom of expression"
WHEREAS Principle 10 of the Declaration of Chapultepec establishes "no news medium nor journalist may be punished for publishing the truth or criticizing or denouncing the government."

to express satisfaction at the IACHR report that defends the journalists of El Universo, among others affected by the Rafael Correa government's policies of censorship, persecution and repression
to welcome the action of the Constitutional Court and urge it to maintain its line of respect for the Constitution and international instruments that protect press freedom
to urge the Executive and Legislative Branches that in the treatment of the amendment to the Democracy Code there be observed the international standards that guarantee the freedom of expression of the candidates and citizens, the commercial rights and the rights of the news media.
